What does a notary public do?

Before booking an appointment, it’s a good idea to understand what this act does — and what it doesn’t do. This difference avoids rejections, double trips and returned documents. 

A notarial act is a formal procedure in which a Florida notary public verifies the signer’s identity, confirms willingness when required, and completes the appropriate notarial certificate. Chapter 117 of the Florida Statutes governs these acts. Examples include a signature acknowledgment, an oath or affirmation, and an attested photocopy of an eligible document.

Notarization has defined legal limits. It does not establish the truth, legality, or enforceability of the document’s contents, and it does not guarantee acceptance by the receiving authority. That authority may impose additional requirements concerning language, witnesses, format, authentication, apostille, or translation. We therefore follow the document’s instructions and the receiving authority’s stated requirements when completing the applicable notarial certificate.

Signature Acknowledgment

You represent to the Florida Notary Public that the signature is yours and that you signed voluntarily. The receiving authority or the document's instructions determine whether an acknowledgment is required.

Oath or affirmation (Oath · Jurat · Affidavit)

You swear or affirm that the statements in the document are true, then sign in the Florida notary public's presence. It is the basis of every sworn statement.

Certified copy (Attesting a Photocopy)

For an eligible document, the photocopy is made under the Florida notary public's supervision and compared with the original before the notary completes the attested-copy certificate. It only applies to documents that are not public records.

Solemnization of Marriage

Florida is one of the few states where the Florida Notary Public can officiate weddings. The marriage is valid when the couple presents a valid Florida marriage license and all statutory requirements are met.

VIN (Vehicle Identification Number) Verification

The notary verifies the vehicle identification number (VIN) shown on the vehicle and completes the applicable verification form. This procedure is commonly required when a vehicle is brought into Florida from another state.

Opening a Safe-Deposit Box

When the statutory conditions apply, a Florida notary public may attend the opening of a safe-deposit box and complete the required certificate describing the property found. The financial institution coordinates the procedure.

What about online notarization? Since 2020, Part II of Chapter 117 has authorized remote online notarization (RON). Eligible notarial acts may be performed through real-time audio-video communication using identity verification, an electronic notarial seal, and a recorded session. A qualifying signer may therefore participate remotely without traveling to Miami, subject to the statutory, identity, document, and platform requirements. “I can't go to an office”

You may be outside Florida or the United States, or unable to travel because of health, work or hospitalization.

“My document goes abroad”

Depending on the destination and receiving authority, your document may require a specific notarial certificate, an apostille or other authentication, and a certified translation. However, no one explains the order of the steps.

“They require witnesses and I do not have them”

Some documents require witnesses in addition to the Florida Notary Public. Furthermore, getting them on time is not always easy.

It is a formal act in which a Florida notary public verifies the signer’s identity, confirms willingness when required, administers an oath when applicable, and completes the appropriate certificate under Florida Chapter 117. It does not validate the document’s contents or guarantee acceptance by a receiving authority.

For an acknowledgment, you appear before the notary public and acknowledge that the signature is yours and was made willingly; the document may have been signed earlier. For a jurat, you take an oath or affirmation and sign in the notary public’s presence. The receiving entity determines which certificate it requires; that is why we confirm it before the appointment.

Florida law authorizes acts including signature acknowledgments, oaths and affirmations, attested photocopies of eligible documents, marriage solemnization, VIN verification and certain safe-deposit-box procedures. Additionally, Part II of the same chapter authorizes remote notarization (RON) since 2020.

No. A Florida notary public may not attest a photocopy of a birth certificate or another vital record. Birth certificates and other vital records are public records issued by their official custodians. A certified copy must come from the official records custodian. We can assist with a request through our Vital Records service. On the other hand, a Florida notary may attest a photocopy only when the document qualifies under Florida law.

Bring current identification acceptable under Florida law, such as an eligible driver’s license, state identification card or passport. Contact us before the appointment if your identification situation is unusual so we can confirm the applicable statutory requirements without providing legal advice.

It depends on the act. If it is an oath (jurat), no: you must sign in the presence of the Florida Notary Public. On the other hand, if it is an acknowledgment of signature, you may have signed before. At the appointment, you acknowledge that the existing signature is yours. When in doubt, do not sign and ask us first.
